Application and Other Fees

1.0 INTRODUCTION

This policy directive establishes tariffs or fees for providing administrative and technical services in the water resource management area.

2.0 BACKGROUND

Application and other fees have been collected under this policy and its successor since October 1996.

3.0 LEGISLATION

3.1 Section 21 of the Executive Council Act.

This section allows the minister to establish tariffs or fees to be paid to government for inspections, issuing licences, permits, grants, conveyances or in respect of applications for same and for searching of a register, file or document kept by the department.

3.2 Water Resources Act, SNL 2002 cW-4.01, ("the Act")

Various permits and licences must be applied for under Sections 14, 36, 37, 39, 48, 58, and 61 of the Act. This Act covers water use licences, permits of waterworks and wastewater works, permits in connection with protected water supply areas and permits to alter a body of water.

4.0 Fee Schedules:

4.1 Application Fees for Water Use Licences under Section 14 of the Water Resources Act, SNL 2002 cW-4.01.

Municipal
Municipality with population up to 500 persons $100
More than 500 up to 1,000 $150
More than 1,000 up to 5,000 $250
More than 5,000 $500
Commercial and Industrial
Marine aquaculture $100
Commercial $100
Industrial $500
Cooling, washing dust or sand or gravel, and asphalt plants $200
Other temporary withdrawals (i.e. portable pumps) $100
Water Bottling and Other Finished Water Based Products
Water removal from surface, groundwater sources or icebergs $1,000
Water Power
Plants with capacity up to 5 MW $2,000
More than 5 up to 10 MW $5,000
More than 10 MW $10,000
Request for amendment of a water use licence $50

4.2 Application Fees for Permit of Waterworks and or Wastewater Works under Sections 36 and 37 of the Water Resources Act, SNL 2002 cW-4.01.

4.3 Application Fees for Designations and Permits under Sections 39, 58, 61 the Water Resources Act, SNL 2002 cW-4.01.

4.4 Application Fees for Permits under Section 48 of Water Resources Act, SNL 2002 cW-4.01.

Bridges
A bridge spanning less than 5 metres $100
A bridge spanning 5 metres or more but less than 10 metres $200
A bridge spanning 10 metres or more but less than 30 metres $500
A bridge spanning 30 metres or more $1,000
Culverts:
A culvert less than 1200 mm in diameter or width $50
A culvert greater than or equal to 1200 mm in diameter or width $100
Dams and Related Works:
A hydro-electric power project control dam $2,000
All other control dams including dykes and berms $50
A water intake greater than 100 mm or infiltration gallery $500
A pipe or conduit installed under any body of water including intakes less than 100 mm in diameter $50
Drainage Works:
A storm drainage work involving discharge into a body of water $200
A ditching system for peat mining or agriculture $200
A settling basin $100
Other Construction:
A water course diversion, channelization, or infilling $500
Exploratory drilling through or under water (per site) $100
Use of winter or ice roads across any body of water $50
Fording (per site), transmission line inspection, ATV or a pedestrian bridge $50
Any construction, grubbing, clearing or installation of structures within 15 m of the high water mark of a body of water if not specifically carried out in conjunction with any other category of this fee schedule. $50

4.5 Water Well Drilling Licence under the Well Drilling Regulations NLR 63/03

Annual Licence Fee $100

4.6 Request for Information and Documentation

Copies of documents, certificates, reports $.25 /page
Processing and compiling data $20 /hour
Electronic data put on diskette, tape or e-mailed $20 /item
Electronic Bulletin Board Access Account $250 /year
Water Well Data for Newfoundland and Labrador CD 1950-2002 $50

4.8 Publications

An appropriate cost shall be determined for any reports, publications, computer applications software or any miscellaneous products. Where prices have already been set for such items, the same prices shall remain in effect.

5.0 OTHER PROVISIONS

Fees are non-refundable. This means that there is no refund if the application is not recommended for approval or if the licence or water use authorization is not issued. If an application for approval is incomplete and/or the applicant must provide more information or revise the same application then no further application fees will be charged. HST will be charged.
